General terms and conditions

1. Scope and object of the contract.
1.1. The General Contract Conditions govern the relationship between Villagraziosa (hereinafter “Villa”) and the Client regarding the provision of hospitality services chosen by the Client in the booking proposal, among those offered by the Structure.

1.2. The request for the provision of the Services can be made by the Client by presenting the Booking Proposal to the Villa in the following ways: by sending an e-mail to the mailbox: villagraziosabb@gmail.it; by phone, in verbal form, by contacting the number +39 3337873019.

1.3. The contract is considered finalized when the customer submits the booking proposal in the manner provided for in point 1.2. and informs the Villa. In the event of a reservation for the future, the contract is considered finalized upon receipt of the deposit in accordance with the terms and methods set forth in paragraph 3 of this agreement. The actual conclusion is always subject to the availability of the Service. This confirmation is provided by the Villa together with the receipt of the proposal or immediately afterwards.,

1.4. If the activation of the Services cannot take place due to impediments not attributable to the Villa, the contract will be automatically terminated, without this implying any kind of liability of the Villa towards the Client.

2. Activation and provision of the service.
2.1. When the Service is activated, the Villa guarantees the Client:
– enjoyment of the furnished housing unit.
– the possibility to enjoy outdoor spaces (garden, swimming pool, parking, internet connection, lounge, kitchen, barbecue)
– The Villa has an outdoor swimming pool that is made available to guests. The pool has no security personnel; the use of the swimming pool is therefore at the customer’s own risk. Children under the age of 14 must not use the swimming pool without adult supervision. The linen in the rooms cannot be used in the swimming pool. The Villa will not be held responsible for damage resulting from improper use of the swimming pool.

2.2. The Client will indemnify the Villa from any prejudice, damage, liability, expense, even legal, incurred or incurred by the Villa, and will also release him from any action, reason, claim made by third parties against it that finds cause or reason for behavior and / or omissions. in any case attributable to the Customer himself or in any case deriving from non-compliance and / or violation of the precepts provided for by these General Terms and Conditions.

3. Reservation and deposit.
3.1. In the event of a reservation, the Villa requires the Customer to pay a deposit of 55% as a deposit, to be sent with the current means:

– other in cash upon agreement with the owner.

3.2. The amount that the customer must pay as a deposit is € 3.600.00 and must be paid within 12 hours. Failure to pay the deposit within the terms indicated above will result in the forfeiture of the reservation, without the need for any communication from the Villa. The remaining € 5.400.00 will be paid 30 days before arrival.

3.3 The cost of staying in the Villa is € 9.000.00, the tourist tax is not included which is € 2.00 per adult per night and only for the first 7 days of stay.

3.4 Upon arrival at the villa the sum of € 1,000.00 must be deposited in cash for any damage to the Villa, in the absence of damage this sum will be returned in full at the end of the stay.

4. Duration of the contract, cancellations and penalties.
4.1. The contract is valid and effective from the date of conclusion of the contract and ends if both of the following conditions are met:
– the Client and the third parties connected to it, or dependent on it, have definitively left the Villa
– the Client has paid the full amount due to the Villa.

4.2. Check-in must be between 16:00 and 18:00, it is not possible to use the entire property before this time. Any arrivals after the check-in time must be agreed in advance with the Villa. Failure to communicate may lead to long waits, for which no complaints or refund requests will be accepted. Check-out must be done strictly until 10:00.

4.3. The customer has the right to cancel the reservation which is reinforced by a deposit and to withdraw from the contract. In this case, he is entitled to a variable refund amount of the deposit paid. This fee is based on the anticipation (with respect to the scheduled check-in date) with which the Client informs the Villa of the cancellation.

The redemption fees are as follows:
90 or more days before: 100% of the deposit
from 89 to 30 days before: 20% of the deposit

The entire rental amount will be retained by the Villa as compensation for damage from the twenty-nineth day of the expected arrival.
In case of no show: the customer will have to pay the entire booked stay.
No reimbursement is foreseen for the guest who leaves the Villa early whatever the cause.

5. Privacy protection.

5.1. The Customer is informed, pursuant to article 13 of the Legislative Decree n. 196/2003 and of the EU Regulation n. 2016/679 called “GDPR”, that the processing of personal data provided to the Villa is necessary to allow the Villa directly or through third parties to fulfill the obligations deriving from this contract or for the fulfillment of the obligations established by law or regulations.
5.2. The data controller is the legal representative of the Villa.
5.3. The acquired data will be kept for the duration of the Service and for the subsequent retention period imposed by current legislation.

6. Identification of documents.

6.1. Upon arrival at the Villa, the Client must deliver the identity documents (passport, identity card) valid for registration as required by current legislation. Failure to comply with this obligation constitutes a violation of the provisions of the criminal code and authorizes us to request immediate departure from the Villa. The data of our guests are treated in accordance with the current privacy legislation.

7. Liability of the Villa.

7.1. The Villa will be responsible for the breach of the contract and the provision of the Service exclusively for the fact attributable to it.
7.2. If the Customer finds a different Service from the one agreed upon arrival but accepts it anyway, the right to any claim for damages is automatically excluded and the new Service replaces the one previously agreed with the agreement of the parties.

8. Limits of Liability

8.1. The Villa will not be responsible in case of delays, inconveniences, malfunctions and / or interruptions of the service due to:
– fortuitous event or force majeure.
– tampering or interventions on the service or equipment carried out by the Client or by third parties not authorized by the Villa.
– damage or inconvenience caused by the total or partial interruption of the supply of electricity or water.

9. Management recommends

9.1. Silence / Children. Total silence must be observed from 24:00 to 08:00
An adult must always accompany the children. In any case, it is mandatory to maintain a behavior that at any time of the day and in no way can damage the peace of others;
9.2. Cleaning. The rearrangement of the villa is every three days. The villa must be left available by 10:00 for cleaning. If the villa is not made available by 10:00, cleaning will be done after 3 days. Please kindly organize your personal belongings in order to allow for such cleaning;
9.3. Other guests.
It is strictly forbidden to bring other people into the Villa, on the terrace and in any area of the Villa without the authorization of the manager, there is a penalty of € 250.00.

The customer cannot sub-rent or dare to loan the Villa in whole or in part, otherwise he will lose the amount of the reservation and a penalty of € 250.00 will be charged for each person taking over.

9.4. Smoking / Weapons / Drugs. It is strictly forbidden to bring in weapons, drugs and more. Failure to comply with this prohibition will result in the immediate resolution of the contract. It is also strictly forbidden to smoke inside the villa. It is possible to smoke freely on the terrace and on the balconies of each room or in the garden, strictly using the ashtrays.

9.6. Kitchen. The use of the kitchen is allowed.

9.7. Animals. It is strictly forbidden to bring animals of any type or size;
9.8. Toilet. We recommend a correct and civil use of the toilets, avoiding throwing anything except toilet paper in the toilet. (for other waste, use the appropriate bins).

10. Damage.

10.1. Any damage to the Villa not reported upon arrival by the customer and found by the staff during the stay will be entirely borne by the customer, after inspection by the competent technicians, according to the rate table.

10. Transaction clause
If the Parties intend to apply to the ordinary judicial authority, the competent court is that of the place where the villa is located.
Although not expressly agreed, this contract is governed by the provisions of the Civil Code on contracts in general.
